Summary of the Request
The Request describes potential harm to the living conditions, health, and property value of the residents of San Andrés and surrounding neighborhoods, in the Tucumán Province, Argentina. The damages are consequence of the construction of an open sewage treatment plant in a residential area that continues to grow and attract more residents.
In addition, the Request mentions potential harm to agricultural activities in the area due to the disposal of sewage waste in the nearby Sali-Dulce river, which runs through three neighboring provinces.
The Request also informs about the lack of consultation, availability of information and documentation regarding environmental impacts. To this day, they alleged, many residents still remain unaware of the realization of the Project.
Recent actions
On October 5, the Recommendation not to conduct a Compliance Review was circulated to the Board of Executive Directors who approved it on October 12, 2022. Consequently, MICI finished processing the request.
Past actions
On November 2, 2021, the MICI granted the Requesters a maximum period of 10 business days to submit the information required to continue with the Request process (paragraph 20 of the MICI Policy). The term expires on November 16, 2021.
On November,17 2021, MICI notified the Requesters and Bank Management of the registration of the Request.
On January 28, 2022, MICI determined that the Request was eligible because it met all the eligibility criteria established in the MICI Policy. This determination of eligibility is not an assessment of the merits of the Request or of the issues contained therein.
The Request was transferred to the Consultation Phase as per the decision of the Requesters.
On July 21, 2022 MICI issued the Consultation Phase Assessment Report, finding that the a dialogue process was not feasible. Pursuant to paragraph 29. B of the MICI Policy, the request will be transferred to the Compliance Review Phase. The deadline for the elaboration of the Recommendation for a Compliance Review and Terms of Reference is August 22.
On August 22, the draft Recommendation not to conduct a Compliance Review was sent to the parties. No comments were submitted.
