Summary of the Request

The Request states that the construction of a bus lane on the 25 de Mayo Highway will increase the harm caused by the noise pollution that the Requester has been experiencing for the past 11 years while living in a building adjacent to that highway in the city of Buenos Aires. The Requester alleges that the noise exceeds the maximum tolerable levels established by the World Health Organization, and that the Bank-Financed Project will exacerbate the impact of the noise created by the highway.

The Request was transferred to the Consultation Phase for a determination of eligibility.

The Request was declared ineligible at the Consultation Phase on October 15, 2014, due to: (a) the existence of open legal cases related to the issue presented in the Request (exclusion set forth in paragraph 37(i) of the Policy); and (b) the fact that the Bank Program did not at that time provide funds for the construction of the bus lane on the highway nearby the Requester’s home, which was the reason for the concern about potential incremental harm (exclusion 37(c) and (a)).

On November 7, 2014, the Request was transferred to the Compliance Review Phase as sought by the Requester for a determination of eligibility. The Request was declared ineligible to comply with the exclusion 37 ( c ) of the ICIM Policy, because the concerns expressed by the Requester are not related to actions or activities related Financed Operation the Bank. After the determination, the Executive Secretary proceeded to close the case.
