Sanctions proceedings pursuant to Section 8.3 of the Sanctions Procedures.
The Office of Institutional Integrity submitted a Statement of Charges and Evidence against two principal Respondents for allegedly engaging in a fraudulent practice related to a contract to build a substation for medium voltage electrical lines in connection with the Rehabilitation of the Electricity Distribution System in Port-au Prince. In accordance with Section 8.3 of the Sanctions Procedures, OII also requested that any sanction imposed on the principal Respondents be extended to an individual Respondent (“8.3 Respondent”) who exercised control over the investigated corporation. The Sanctions Officer (“SO”) determined there was insufficient evidence to find under the preponderance of evidence that the principal Respondents engaged in the alleged fraudulent practice, dismissed the charges and terminated the proceedings.
In accordance with Section 8.3 of the Sanctions Procedures, the SO determined that no sanction existed that could be extended. Accordingly, the SO terminated the proceeding against the 8.3 Respondent. The SO’s Determination was final.
