The Request describes a potential damage to the assets and living conditions of the Requesters due to irregularities in the expropriation process within the framework of the Project.
Additionally, the Requesters state that due to the above situation they have had the loss of their small business and means of subsistence, as well as a disproportionate collection of real estate taxes.
The Request also reports on incidents of violence and acts of intimidation that are allegedly linked to their opposition to the expropriation process in question; reason for which they requested the confidentiality of their identities.
On November 29, 2022, the MICI determined that the Request is not eligible because it does not meet some of the eligibility criteria required by the MICI Policy. Specifically, the Request does not comply with criterion 22 (c) because it is unable to link the allegations of harm to the operations financed by the Bank. In addition, the Request does not comply with criterion (e) by applying the exclusion on Requests submitted more than 24 months after the last disbursement of the Bank-financed operation to several operations.
This eligibility determination is not an assessment of the merits of the Request and the issues presented therein. Nor is it a determination of compliance or noncompliance by the IDB with its Relevant Operational Policies. Upon notification to the Board of Executive Directors, the processing of the Request by the MICI will be terminated.
On September 12, 2022, the MICI granted the Requester an extension of 10 working days to provide additional information needed to process the case. In addition, MICI referred them to the Office of Institutional Integrity in case they wanted to address their concerns in that instance.
On September 27, 2022, MICI notified the Requesters and IDB Management of the registration of the Request.
