Requesters

8 residents and merchants of the city of Bogota, led by Mr. Carlos Adrián Flórez García.

Summary of the Request

The Request describes a potential damage to the Requester's property and living conditions derived from the expropriation of his residential property, within the framework of the Project.

The Requester alleges an incorrect appraisal of his property, since the amount offered would be less than an appraisal cited by the Requester. On the other hand, he argues that the loss of profits was not considered and that the expropriation would be depriving him of his livelihood.

The Request claims that no payment derived from the expropriation has been made, as well as inconsistencies in the notification process and noncompliance with the Project's General Resettlement Plan.

This Request is related to the compliant MICI-BID-CO-2021-0179.

Recent Actions

After verifying compliance with the agreements reached by the Parties, MICI produced a Case Closure Report that was distributed for information to the Board of Executive Directors on April 12th, 2023. With said Report, MICI concluded the case's management.

Past Actions

On February 22, 2022, the MICI granted the Requesters a maximum period of 10 business days to submit the information required to continue with the Request process (paragraph 20 of the MICI Policy). The term expires on March 8, 2022.

On March 11, 2022, the MICI notified the Requesters and Management of the registration of the Request.

On May 6, 2022, MICI determined that the Request was eligible because it met all the eligibility criteria established in the MICI Policy. This determination of eligibility is not an assessment of the merits of the Request or of the issues contained therein.

The Request was transferred to the Consultation Phase as per the decision of the Requesters.

On August 19, 2022, as a result of a collaborative dialogue facilitated by MICI, the dispute resolution process culminated with the signing of six agreements between the Bogotá Metro Company, IDB Management and the Requesters. Given the situation of each Requester, the agreements describe in detail the specific actions that must be undertaken to address each resettlement case and the deadlines to complete the commitments made by the three parties.

On September 20, 2022, the Consultation Phase Report, including the Agreement reached and the Monitoring Plan, was distributed to the Executive Board for their consideration by short procedure. In this case, the Evaluation Report is included in the Consultation Phase Report because, given the particularities of the complaint, MICI proposed the implementation of an intensive and quick methodology, and jointly carry out the Evaluation and Consultation Phase Process stages.

With the approval of the Monitoring Plan by the Board on September 27, the Monitoring of Agreements Stage, which’s full compliance is expected in 2022.
