Communities of the municipalities of Bucaramanga, Barrancabermeja, San Vicente de Chucurí, Betulia, Grión and Lebrija in the Department of Santander, Colombia; represented by Gabriel Rangel Mogollón of the organization Veeduría Ciudadana da la Ruta del Cacao VCRC-4G.
The Requesters allege negative environmental effects, as well as on their living conditions, their patrimony and their health linked to the construction work and future operation of the highway; which would be generated by inadequate management of environmental and social risks. Specifically, the Request states:
- Possible environmental impacts from the contamination of bodies of water, soil and air that would have been caused by the materials used for the construction of the road, by a potential mishandling of waste and excessive deforestation. This situation, they claim, would be generating significant damage to the flora and fauna of the area.
- Possible impacts on their living conditions and patrimony as construction work would have caused structural damage to homes and businesses where the road crosses. Likewise, they comment on the lack of an adequate resettlement process and subsequent compensation of the affected populations.
- Possible health impacts which would be linked, during the construction stage, by excessive noise, dust and improper waste management. Similarly, regarding potential damages during the commissioning of the road, they warn of a significant increase in vehicular traffic in the area.
On February 28, 2023, the Board of Executive Directors approved an extension of the deadline to submit comments on the draft Recommendation for a Compliance Review and Terms of Reference. The new deadline expired on March 3.
2023
On February 1, 2023, the Compliance Review Phase shared the Draft Recommendation with Management and Requesters.
On January 20, 2023, the Executive Board approved an extension of the deadline for the preparation of the draft of the Recommendation for a Compliance Review and Terms of Reference. The new deadline expired on February 1.
2022
On December 9th, the Board of Executive Directors considered by Short Procedure the Consultation Phase Report. The Report concluded that an agreement was not feasible during the Consultation Phase, and the request was transferred to the Compliance Review Phase.
2021
On August 31, 2021, the deadline of the Consultation Process was extended for an additional 12 calendar months, in accordance with the extraordinary measures adopted in the face of the pandemic.
2020
On August 14th, MICI submitted its Assessment Report of the Consultation Phase, indicating that a dispute resolution process is feasible. During this stage, the Mechanism conducted 22 bilateral meetings with the Parties and their advisors, as well as a multilateral virtual meeting with representatives from the Client, the IDB Invest and the Requesters. Given the disruptive effects of the COVID-19 pandemic and the extraordinary measures taken to control its spread, the deadline for the Assessment Stage was extended. MICI-IIC Policy Deadline extensions were approved by the IIC's Board of Executive Directors on April 2nd, 2020.
On March 20, MICI determined that the Request was eligible because it met all the eligibility criteria established in the MICI Policy. This determination of eligibility is not an assessment of the merits of the Request or of the issues contained therein. The Request was transferred to the Consultation Phase as per the decision of the Requesters.
On January 6, 2020, MICI notified the Requesters and Bank Management of the registration of the Request.
