Summary of the Request

The Request alleges possible impacts on the livelihood of the Requesters. Specifically, due to the lack of progress on the design and implementation of complementary construction work to guarantee water usage rights for the Requesters during the future operation of the Alto Maipo project.

Recent actions

On April 22, 2019, MICI determined that the Request was not eligible because it didn’t meet two eligibility criteria established in paragraph 22 of the MICI Policy.

Regarding the alleged harm, criterion 22 (c) is not met, because if IDB Group's Management maintains the current performance of compliance monitoring, MICI considers that the alleged harm does not present a "reasonable probability of happening" at this time. Additionally, to date, based on the information received from the Requesters, the water rights of the Requesters have not been affected. On the other hand, exclusion 19 (d) applies, because the issue raised in the Request is currently the subject of an active judicial process.

This determination of eligibility is not an assessment of the merits of the Request or the issues presented in it.

MICI notified the Requesters and Management, and the process concluded. 
 

Past actions

On February 5, 2019, MICI granted the Requesters a period of 10 business days to send the information required to continue the Request process (paragraph 20 of the MICI policy), which was received on February 20, 2019.

On February 22, 2019, and once having all the required information, the MICI notified the Requesters and IDB Management of the registration of the Request.
