A group of 60 residents of Villa Anita neighborhood, Moreno Partido, Buenos Aires Province, Argentina, who are accompanied by Leonardo Filippini, Federal Prosecutor of Moreno.
The Request describes potential harm to the quality of life and access to public utilities of the group of Requesters due to the construction and distribution of sewer pipelines and water collectors, which are part of the Environmental Sanitation Program.
Specifically, they allege that the works were abruptly interrupted, resulting in streets with wrecked sidewalks and the suspension of services. In addition, they assert that their environment has been degraded by the noise and the presence of rubble and waste derived from the cessation of the construction. In the same way, the Requesters claim economic harm since they have been bearing the costs of fixing sidewalks, pumping water, and cleaning the spaces, which are derived from the suspension of services.
The Request also mentions potential non-compliance with the Bank's Relevant Operational Policies due to the lack of public information on the timeframe and conclusion of the project. Additionally, since the contractor in charge of the works declared bankruptcy, the information regarding the bidding process is insufficient and unavailable.
This Request is directly linked to compliant MICI-BID-AR-2022-0187.
On October 24, 2022, MICI issued the Consultation Phase Assessment Report indicating that a Consultation Phase facilitated dispute resolution process is feasible.
On July 13, 2022, the MICI notified the Requesters and Management of the registration of the Request.
On September 6, 2022, MICI determined that the Request was eligible because it met all the eligibility criteria established in the MICI Policy. This determination of eligibility is not an assessment of the merits of the Request or of the issues contained therein.
The Request was transferred to the Consultation Phase as per the decision of the Requesters.
