Requesters:

Three Brazilian citizens, residents of Jardim Itatinga, São Paulo. The Requesters are being represented before the MICI by their attorney.

Summary of the Request

The Request alleges harms to the quality of life of the Requesters, due to the proximity of their homes to the construction site of the highway, which is part of the Project. The Requesters claim that their properties should have been considered eligible for expropriation under the Resettlement Plan prior to the commencement of the Project’s construction ; and that, due to this, they have been exposed on a daily basis and during extreme hours of the day, to conditions of high levels of sound pollution (due to the explosions necessary for the construction), poor air quality (due to suspended particles in the environment and chemical products used by the Project) and strong vibrations caused by machinery traffic and the equipment necessary for construction.

Recent actions

On May 19, MICI determined that the Request is not eligible because it does not meet the eligibility criteria set forth in the MICI Policy, as the Requesters decided to withdraw their claim in order to explore alternative resolutions. After notifying the Parties about this decision, the process was concluded.

On March 22nd, 2017, the Request was registered and notifications were sent to Requesters and Bank Management.
